A MISTRIAL has been declared in the case of three friends accused of murdering a nursery owner north of the Gold Coast.
Adam Kenneth Terry, 44, Michelle Josephine Warren, 31, and Brett Andrew Seymour, 25, have all pleaded not guilty to murdering Brian Bathgate, 55, in August, 2009.
Police found the charred remains of Bathgate in the tray of his ute, which had been doused with petrol and set alight in a cane field on the Logan River at Eagleby.
The trial began on Wednesday in the Supreme Court in Brisbane where it was heard Warren allegedly had animosity towards Bathgate for assaulting her mother.
But the case came to halt on Thursday morning when Justice Debra Mullins ordered a mistrial.
The court heard the cause of the mistrial involved the prosecution not providing specific evidence.
