Judge aborts murder trial after fresh evidence emerges

THE jury in the Lin family murder trial has been discharged after fresh evidence which could change "the face and shape" of the Crown case was brought before the court.

For the past month Robert Xie has been on trial over the bludgeoning murders of his brother-in-law, his wife, her sister and their two young boys.

The court heard on Tuesday that as the Crown sought to tender material which had not been available ahead of the trial.

In his address to the jury, Justice Peter Johnson noted the time they had spent on the case and thanked them for their service but said as the material could "make a substantial difference" to the trial, and the defence team had not had the chance to study it, they would be discharged without having reached a verdict.

The trial will begin again before a different jury at a later date.
