OPINION: Magistrate blundered in ignoring video

I HAVE always steered away from criticising the judiciary over the severity or leniency of a sentence.

I believe that to do that you need to sit in the courtroom for the entire trial and listen to all the evidence.

That said, for a magistrate this week to have refused to watch a brutal video of a cowardly attack on another man before sentencing the attacker is beyond belief.

If clear video evidence is available it must be watched by the magistrate and noted, otherwise why do we bother to have CCTV cameras.

Maroochydore Magistrate Rod Madsen made a monumental blunder when he delivered a non custodial sentence to serial offender Tyson Joel Wylie.

He amazingly claimed that he didn't like watching videos because they could be "emotive".

Wylie's attack on a stranger at a Sunshine Coast taxi rank occurred just six days after this coward committed a similar attack on the Gold Coast.

The police must be destroyed by these sentencing blunders, how can they deliver a stern message on one punch attacks when the judiciary continues to let these idiots go free.

At least here in Ipswich we have magistrates who do watch incriminating videos and who also don't let the bottom dwellers of Ipswich run free by giving them a slap on the wrist every time they front court.
