Man fronts court after 'manipulating' his genitals in public

A MAN said he was only trying to "adjust" his genitals after he was caught with his hand in his pants at the Bluewater Lagoon.

Police were called to the popular location after receiving a call that a man was masturbating at the site.

Glen Garry Saddler, 45, pleaded guilty in the Mackay Magistrates Court today to being a public nuisance.

Witnesses, who said they were only metres away from Saddler, said they observed him "rhythmically manipulating his genitals", prosecutor Constable Duncan Erskine said.

The court was told Saddler was facing toward a young girl, aged about 13-years-old, who was a patron on the pool.

Saddler told officers he'd placed his hand in his pocket and touched himself to "adjust" his genitals, Const Erskine said.

Witnesses told police they observed Saddler "manipulating" his penis inside his pants for five minutes and then one minute, the court was told.

Saddler was told to stop his behaviour. The police were called and he was removed from the area, Const Erskine said.

Defence solicitor Zoe Craven, of ATSI Legal Services, said Saddler suffered from depression but was not currently taking medication because of a bad reaction he'd had some time ago.

He was planning to see a doctor to go back on medication, Ms Craven said.

Saddler "accepts his behaviour was inappropriate". He "wasn't directing his behaviour" at anyone, she said.

He didn't want to make further submissions about the reason for his behaviour, Ms Craven said.

The court was told Saddler had four prior convictions for being a public nuisance, but Ms Craven said the circumstances were different to this matter.

Const Erskine said unless medical documents were produced he submitted that any medical conditions shouldn't be taken as a mitigating factor for Saddler's behaviour.

Magistrate Ross Risson adjourned the matter until later this month for sentence so that Saddler could seek further medical advice and counselling.
