NAIDOC artist jailed after indecent dealing with young girl

A FORMER NAIDOC Queensland artist of the year has been jailed for indecently touching a 10-year-old girl multiple times.

Brian Dempsey Fisher, 51, appeared in Mackay District Court before Judge Leanne Clare, via videolink from Lotus Glen Correctional Centre on Tuesday.

Defence barrister Bronwyn Hartigan said Fisher is a well-known Queensland aboriginal artist and was a NAIDOC Queensland artist of the year in 1988.

The Cherbourg Aboriginal elder was sentenced on three counts of indecent treatment of a child aged under 12, between April 20 and April 22, 2016. He pleaded guilty to the charges.

Fisher was a travelling artist at the time of the offences.

The girl, who did not know Fisher, was touched on the genitals three times, twice while she was in bed and a third time in a yard of a home.

The girl told Fisher to stop and reported his behaviour to family members, who went to Queensland Police.

Judge Clare said Fisher's "terrible fall from grace" could not be tolerated and his sentence needed to act as a deterrent.

Taking into account Fisher's guilty plea, lack of similar criminal history and remorse, Judge Clare sentenced him to 15 months jail, suspended after four months. The sentence will hang over Fisher's head for two years.

Judge Clare placed Fisher under police supervision for five years.
