'Nuisance' told to get off grog and back on medication

A MAN who caused a disturbance at a busy Toowoomba shopping centre has been told by a city magistrate to get off the grog and back onto his medication.

Kallum John Gillan was drunk when he entered a Grand Central Shopping Centre liquor store on December 2, Toowoomba Magistrates Court heard.

An off-duty police officer in the store at the time, saw the 36-year-old select a bottle of bourbon and place it down his pants before appearing to walk out.

The officer told the store's manager who followed the shop-lifter but he had left the area, swearing and staggering as he made his way through the crowd.

However, when he returned to the store about 3pm that same day, the female store attendant stepped in front of him to try and keep him from entering the shop, police prosecutor Mike Robinson said.

Saying "Hello beautiful", Gillan put his hand on the woman's chest as he went to push past her to enter the store, prompting the woman to cross her arms "feeling violated".

When she went to call police, Gillan left the store, Sergeant Robinson said.

About 6pm police attended the Taylor St boarding house at which the defendant was living at the time to find an almost empty bottle of bourbon and a cupboard which had been damaged by the drunken Gillan punching it, the court heard.

Having spent the night in custody of the watch house, he appeared in court to plead guilty to public nuisance within a licensed premises, common assault in a public place while adversely affected by an intoxicating substance, stealing, wilful damage and breaching a court order.

His solicitor Claire Graham (Bouchier Khan Lawyers) said her client suffered from paranoid schizophrenia but had been off his medication and drinking alcohol at the time.

There was now a bed available for him at the hospital as a voluntary patient to receive treatment, she said.

Magistrate Graham Lee took into account Gillan's mental health problems and that he was seeking medical help.

"I suggest you get back on your medication so you know what you're doing," he said.

Gillan was placed on 12 months probation and ordered to pay $50 for the bottle of bourbon.
