Party death payout blocked

MACKAY police officer Jonathon Campbell is "very, very disappointed" by a decision to reject workers' compensation for the death of his wife last year.

Mr Campbell's wife Jukes Campbell, of Noosa, worked for retail giant Dan Murphy's.

At a Christmas party being held for the store last year on March 31, Mrs Campbell dived into the Noosa River.

The mother-of-two suffered head and neck injuries and died in hospital two days later.

Mr Campbell originally won the right to her workers' compensation.

However Woolworths' workers compensation insurance arm decided to block the payout by appealing to the Queensland Industrial Relations Commission and the decision was overturned.

Mr Campbell said his solicitor had lodged an appeal so he could not comment further.

"We don't really know what's going to happen at the moment," he said.

"It was very, very disappointing though.

"I didn't tell anyone about it (the judgment) for a few weeks I was so upset."

Woolworths conceded Mrs Campbell had been encouraged to come to the Christmas party.

However they denied Mrs Campbell was encouraged to dive into the Noosa River.

IRC deputy president Daniel O'Connor ruled that Mr Campbell was not entitled to his wife's workers compensation because she had been "on a frolic of her own".

"I am not satisfied, on the balance of probabilities that the deceased's employment was a significant contributing factor to her injury," his findings read.

Mr Campbell is a Senior Constable with Scenes of Crime team in Mackay.

The ruling means Mr Campbell will have to foot the legal bill for Woolworths.
