Man jailed for killing partner continues to appeal

A MACKAY man jailed for life for murdering his partner continues to fight for his freedom.

Today lawyers for Kenneth Michael Martin will try to convince the High Court of Australia to hear his case after two failed attempts to overturn his conviction in the Queensland Court of Appeal.

Martin lodged his first appeal soon after he was convicted five years ago and made another appeal earlier this year.

The Queensland Court of Appeal rejected both and Martin is now taking it to the higher court.

Martin initially pleaded not guilty to murder and guilty to manslaughter after he stabbed his partner Darlene Saltner to death at Slade Point in 2008.

He was found guilty of murder in a four-day trial in August 2010.

During his first appeal his lawyers argued the guilty verdict was unreasonable because Martin was drunk at the time of the killing.

His legal team argued Martin's intoxicated state should have caused the jury to doubt that he had intent to harm his partner.

In February this year his legal team asked the Court of Appeal for an extension of time to appeal the conviction again, arguing information that led to Martin's conviction was fraudulent and improper. This appeal was also rejected.

Both of these appeals will be put before the High Court today that will decide whether Martin is able to take his case further.
