Wiggins Island ordered to change legal documents

WIGGINS Island Coal Export Terminal has been forced to change documents as part of its legal proceedings against an engineering and construction company over work for the 1.8km jetty.

Wiggins was previously ordered to pay money it owed to Monadelphous's engineering and Muhibbah's construction companies.

But Wiggins has argued the amount they were told to pay was more than was required under its contract.

On Wednesday Wiggins was told it would need to amend its statement of claim it had tendered to the court against Monadelphous and associated companies.

Wiggins Island has been locked in a legal battle with Monadelphous, Muhibbah and other associated bodies.

Wiggins contracted the companies to construct the 1.8km jetty at the coal terminal at Gladstone and to supply, manufacture and commission a ship loader and towed tripper as a fixture to the jetty.

A court judgment from Justice David Jackson delivered on Wednesday said Muhibbah issued a revised drawing for the jetty.

Wiggins claimed the companies were not entitled to payment for claimed works because it wasn't within the contract.

Muhibbah asked for parts of the statement of claim to be struck out and Justice Jackson said this should occur.

He also ordered Wiggins to pay Muhibbah's costs for the court proceedings.

A previous adjudication ordered Wiggins to pay about $1.4m for the work but Wiggins argued these ordered amounts were higher than was due under its contract.

That case will be reviewed later this month.
