Nurse refuses to leave pub, police carry her out

A HERVEY Bay nurse has been ordered to perform community service after refusing to leave the Beach House Hotel after a night drinking.

But Moina Teresa Smith, 53, said she was dismayed when security told her she must leave when she complained another patron had inappropriately touched her and spoken to her in a shocking manner.

Smith, who has two adult children, pleaded guilty to failing to leave a licensed premises, obstructing police and failing to provide her name to police.

Police prosecutor Senior Constable Donna Sperling said police were called to the Beach House Hotel about 8.20pm on January 30.

She said when police arrived they found Smith sitting in the doorway of the hotel, blocking pedestrian traffic.

Police requested she stand and move to the footpath with them.

When she refused after at least three police warnings, four officers picked her up and placed her in the police car.

Snr Const Sperling said it took half an hour for police to identify the woman after she refused to give her name.

Defence lawyer Kade Eames said Smith had complained to security after someone had inappropriately touched her and spoken to her in a manner she found shocking.

He said she was shocked when she was told when an incident like that happened it was hotel policy to ask both parties to leave.

Magistrate Graeme Tatnell ordered the woman perform 40 hours community service.

No conviction was recorded.
